The Crown Prosecution Service yesterday said the Oscar-winning actor will face five charges – four for sexual assault and one for another serious sexual offence.
The incidents are alleged to have taken place in London, between March 2005 and August 2008, and in Gloucestershire in April 2013.
The Metropolitan Police said the alleged victims are in their 30s and 40s.
While the CPS has authorised the charges, it is understood the US actor has not been formally charged because he is not in the country.
Rosemary Ainslie, head of the CPS Special Crime Division, said: “The CPS has authorised criminal charges against Kevin Spacey, 62, for four counts of sexual assault against three men.
He has also been charged with causing a person to engage in sexual activity without consent.
“The charges follow a review of the evidence gathered by the Metropolitan Police in its investigation.”
She added: “The Crown Prosecution Service reminds all concerned that criminal proceedings against Mr Spacey are active and that he has the right to a fair trial.”
The CPS would neither confirm nor deny whether Spacey will need to be extradited to the UK.
But in general, an accused person can choose to return to face charges. If this does not happen, prosecutors can seek to begin extradition proceedings.

The Old Vic theatre in London, has won two Oscars – for best supporting actor in the 1996 movie The Usual Suspects and for best actor in American Beauty, made in 2000.
The sex offences charges come after a trailer for his new film, Peter Five Eight, was launched at the Cannes Film Festival.
Spacey, who was not at the French resort, plays a villain in the movie opposite co-star Rebecca De Mornay.
It is not the first time the actor has been accused of a sexual offence.
In 2019, he was arraigned and later appeared in court in Nantucket, Massachusetts, US, after an 18-yearold bus boy alleged Spacey had groped him in a restaurant.
But the case was later dropped because of “the unavailability of the complaining witness”.
In recent years, the actor has kept a low profile but in July, 2021, he was spotted on set in Dunsmuir, California, smoking a cigarette.
Spacey’s representatives have been approached for comment.
